Personal Finances 2
Program License Agreement
YOU ACCEPT THESE TERMS BY USING THE PROGRAM.
Personal Finances 2 is licensed not sold to you. You obtain no
rights other than those granted to you under this license. Spitfire
Software retains all right, title and interest to the Personal
Finances 2 program including all copyright interests.
The term "Personal Finances 2" in this Agreement means the original
and all full or partial copies of the program.
You are responsible for the selection of Personal Finances 2 and
for the installation of, use of, and results obtained from your use
of Personal Finances 2.
1. Registration
In order to use Personal Finances 2 for productive work you must
register your copy with Spitfire Software and receive a
Registration Number at which time your license to use the program
will become effective. Without registering you may only test the
program to determine its usefulness to you.
2. License
Under this license, you may:
1. use a registered copy of Personal Finances 2 on
only one machine at any one time;
2. transfer un-registered copies of Personal Finances 2 to
other parties. If you transfer the program, you must
transfer the entire unmodified program including
documentation. You may transfer it electronically, on
on magnetic media, and on CD-ROM.
Under this license, you may not:
1. Decompile, disassemble, modify or reverse engineer the
program;
2. Prepare derivative works of the program or otherwise
modify it;
3. Alter, modify, remove or cover any copyright notice or
proprietary rights legend placed on or embedded in the
program.
3. Ownership
By licensing this program you agree that the program is owned by
Spitfire Software and that you will take no action which is
inconsistent with Spitfire Software's ownership interest in the
program.
4. Limited Warranty
The expressed limited warranties specified below are only available
to the ultimate end-user of the program, that being the person who
uses it for his own internal business activities or personal uses
and not for remarketing or redistribution.
Media:
Spitfire Software warrants that the media on which the program
resides will be free from defects in material and workmanship under
normal use during the ninety (90) day period after you receive the
program as evidenced by a receipt ("Warranty Period"). If notified
during the Warranty Period that the media is not as warranted,
Spitfire Software will replace such media or, in the event Spitfire
Software is unable to deliver replacement media, you amy terminate
your license and the amount you paid for the license to the program
will be refunded upon your return of all copies of Personal
Finances 2 to Spitfire Software.
Program:
PERSONAL FINANCES 2 IS PROVIDED ON AN "AS IS" BASIS, WHICH MEANS
THAT SPITFIRE SOFTWARE MAKES NO WARRANTY TO YOU, AND YOU ASSUME THE
ENTIRE RISK FOR THE QUALITY AND PERFORMANCE OF THE PROGRAM.
THE FOREGOING WARRANTIES, IF ANY, ARE IN LIEU OF ALL OTHER
WARRANTIES, EXPRESS OR IMPLIED, ORAL OR WRITTEN, INCLUDING BUT NOT
LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS
FOR A PARTICULAR PURPOSE.
Some States do not allow the exclusion of implied warranties, so
the above exclusion may not apply to you. This limited warranty
gives you specific legal rights, nd you may also have other rights
which vary from state to state.
5. limitation of Remedies
In no event shall Spitfire Software or anyone else involved in the
development or distribution of this program be liable for any
damages whatsoever including, without limitation, indirect,
incidental, special or consequential damages, lost profits, losses
from interruption of your business or other similar losses,
resulting from the use of the program, inability to use the program
or any breach of the above specified warranties. This is the case
even if Spitfire Software has been advised of the possibility of
such damages. Spitfire Software's entire liability to you for
actual damages for any cause whatsoever will be limited to the
price you paid for the program that caused the damages. Some states
do not allow for the exclusion or limitation of liability as
specified above, so the foregoing may not apply to you.
